New Legislation Introduced in Michigan House - HB 4759
2007/05/16
Michigan Legislature
--------------------------------------------------------------------------------
May 16, 2007

Introduced by Rep. Daniel Acciavatti, HB 4759 would eliminate Michigan's victim disarmament zones (pistol free areas). HB 4759 was referred to Committee on Judiciary May 15th, 2007. This is the most important bill on concealed carry since 2000. It eliminates "criminal safe zones" and hence will make Michigan safer than it is now. Additional updates and comments may follow later.

Cleveland , Toledo & Columbus are the worse. As of March 14th,2007 a new law in Ohio was passed (HB347)that banned local manicipalities from having their own gun laws. Preemption it is called. Now only state law is allowed and those 3 cities (among others) had many prohibitions on guns that became null and void. The city leaders are ticked off and have encouraged businesses to post using the common scare tactics of anti gun lobbyists.Cleveland even filed a lawsuite against the state of Ohio that is pending. I live in Dayton. It is not nearly as bad this far south. Most of the off limits places here are the ones prohibited by state law as in other states.

side note: Those cities can show no evidence that additional gun controlls did anything to curb crime .

privately owned businesses have the right to prohibit firearms in their establishment if they choose but the "city" can't prohibit it. So the signs you saw were enforcable. Like where I work there is no law that says I can't carry a gun there. The company however says they don't want guns there and have the premises posted so it is their right to do so, That's what has caught barnett3006.

Want more clarification?? It depends on the state--in Texas, some places are outright "no carry" zones, and some are left to the discretion of the owner--but they have to provide a legally-sufficient notice to make possession on their property a subject for criminal prosecution. Then there are the cases like barnetts', where there is no criminal action available, but you can be fired or whatever

In KY, there are the usual no carry zones, ie., schools, bars, government buildings etc, but a business can prohibit firearms in their establishment,. In the store I manage, the only sign I put put up is "NO SMOKING". I don't want to advertise there are no guns in our store, I want them to find out the hard way that there is a gun here. We do have the "Castle Law" here in KY, were by you don't have to barricade yourself in a room and declare you have a gun before you shoot the SOB. Long story short, I would rather be judge by 12 than carried by 6.

I still can't figure out why a store or business should be allowed to override the state and tell me I can't carry in their store. I understand that this is private property but they still invite you in. If the state and feds have cleared you, you would think that some crappy store wouldn't mind. I'm just glad that most stores around here have not gone that far yet.
